These Terms of Use (“Terms”) govern your use of the Mold Scanner mobile application, website, and related services. By using Mold Scanner, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Mold Scanner and have the legal capacity to agree to these Terms.

2. Purpose of the App

Mold Scanner provides AI-assisted, image-based analysis of visible mold or mold-like growth. Results are informational estimates based on the submitted image.

The app does not perform laboratory testing, identify mold species with certainty, measure airborne spores, determine indoor air quality, or guarantee that a photographed area is safe or unsafe.

3. Health and Safety Disclaimer

Mold Scanner is not a medical device and does not provide medical diagnosis, treatment, or medical advice. Do not rely on the app as the sole basis for health, remediation, property, or safety decisions.

If you experience symptoms or believe mold exposure may present a health risk, seek advice from a qualified healthcare professional. For substantial contamination, water damage, or persistent mold, consider a qualified mold inspection or remediation professional.

4. User Responsibilities

• Submit only images you have the right to use
• Use the app lawfully and responsibly
• Do not rely on image analysis as a substitute for professional inspection or testing
• Do not misuse, reverse engineer, disrupt, or attempt unauthorized access to the service

5. Subscriptions and Billing

Mold Scanner may offer auto-renewing weekly, monthly, and yearly subscriptions. Purchases are processed by Apple through the App Store.

• Payment is charged to your Apple account at confirmation of purchase
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
• Your account may be charged for renewal within 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple account settings
• Any trial or introductory offer is subject to the terms shown at purchase

6. Intellectual Property

Mold Scanner and its software, design, branding, text, graphics, and related materials are owned by us or our licensors and protected by applicable law.

7. Disclaimer of Warranties

Mold Scanner is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that analysis results will be complete, accurate, or suitable for any particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for losses arising from reliance on app results, inability to use the app, property damage, remediation decisions, or loss of data or revenue.

To the fullest extent permitted by law, our total liability for a claim relating to the app will not exceed the amount you paid for the app during the twelve months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate access where permitted by law, including for violation of these Terms or misuse of the service. You may stop using the app at any time.

10. Governing Law

These Terms are governed by applicable laws in the United States, without regard to conflict-of-law principles, except where otherwise required by applicable law.

11. Changes

We may update these Terms from time to time. The date above will indicate the latest revision.
